The old job? Thursday I talked to my director. Well, he was happy for me, said that being at a government museum would be good to my career but he’d miss me a lot (just like everybody else said that day, I hadn’t realized all those old guys liked me like that!). However when I asked him to fire me he said it wouldn’t be too easy, of course all Directors would have to agree to that, according to Brazilian laws they’d have to pay me a lot of money and that would be a serious issue. Hum, not good, not good. So while I was praying he was talking to other guys – later he told me the institution’s president, that asshole, didn’t want to fire me but other Directors said we could have a deal, so I would have to talk to one of the guys on following day. My director also told me that probably said deal would involve me returning them part of money after receiving it...

Let me explain it: there’s a thing down here, a kind of fund, that regular employees must have. Our bosses deposit money there every month but we’re not supposed to touch it just in case of being fired or of buying a house/apartment. I’ve been working as a regular employee for 8 years and there are about 2,000 dollars in my fund. The problem is, in case of firing, the boss must pay 40% of fund to employee, and my museum doesn’t want to pay me that, in fact they want me to return them this money. It’s totally illegal but it’s really common, many people here cut a deal to be fired (and receive the fund) and later return their employers the 40% part of it. Of course I was pretty disappointed after talking to another director on Friday and he explained me that, I think I was a good employee for them during 8 years, they could be good for me too at least one more time. But a little less money is better than no money at all, which would happen if I just quit, I wouldn’t be able to touch fund’s money. According to our laws every time one changes from a regular job to another employers transfer funds obligations, continuing to deposit money in funds until one retires (or decides to buy a house, or gets fired), when one can finally use fund’s money. I think there are other cases in which you can use that money too, if one’s sick or something like that.

Anyway, I’ve 2,066 dollars in my fund. My bosses should pay me more 826 dollars for firing me, and I’m totally sure 2,892 dollars mean nothing to them. So why don’t they want me to keep that? I suppose they don’t know exactly how much they’ll have to pay me and as soon their accountant explains that they’ll change their minds. I’ve seen them spending much more than that in parties, damn it!!! Whatever, I won’t make a fuss, if they really need this money they can keep it, I’m out and I’ll be much happier now, that’s what counts!!

Wow, is your boss trying to con you out of money? What an example of public worker.

Why don't you talk to your syndicate or association, maybe they can give you an advice.

É o infame acordo do FGTS, Ana, meu pai, que trabalhou anos na Caixa Econômica, cansou de ver isso. O empregado, louco pra sacar o fundo, entra em acordo com o patrão, que não quer pagar a tal multa de 40% do valor do fundo (além de férias vencidas, 13º salário, horas extra e o que mais o empregado tiver direito). Aí o empregado concorda em receber e devolver os 40%. No meu caso é uma ninharia, meu fundo deve estar em torno de 6.200 reais, os 40% seriam uns 2.400 - pra mim isso não é ninharia, mas pra empresa é, já vi eles gastarem muito mais que isso em um coquetel, só em bebidas. Acho uma sacanagem eles ficarem regulando essa mixaria, mas minha esperança é que quando o contador mostrar os valores eles caiam em si e me liberem de devolver essa grana. Algumas pessoas já me aconselharam a pegar o dinheiro e dar uma de maluca, dizer que não combinei nada, mas isso iria acabar com a chance dos outros colegas de futuramente pedirem pra ser demitidos. Enfim, o contador deve mandar os cálculos pra eles na quarta ou quinta, quando terá outra reunião de Diretoria, espero que pelo menos uma alma caridosa resolva interceder por mim!!!

Ah, é, Adriana. Não estava lembrada desse tipo de acordo. Eu acho essa prática uma sacanagem com o trabalhador. É claro que esse dinheiro não faz falta nenhuma a eles e é um direito seu. Mas realmente é preciso pensar direitinho no que fazer. Tomara que eles sejam justos e não peçam de volta os seus 40%.
